Terms of sale
What you're buying when you buy film in Phold, when it comes, and what happens if something goes wrong. These terms don't take away any rights you have under the law where you live.
You buy from One Man Band Media DC LLC, Washington, DC, United States ("we", "us"). Contact: eammon@phold.photo.
1. What you're buying
A roll of film in Phold is a prepaid order for real photographic prints. When you've shot the roll and handed it in, we have your pictures printed by our print lab and posted to you. The price includes developing, printing on photo paper, the lab's packaging and postage to the address you gave in Apple Pay.
- A roll prints as many pictures as its camera takes: for example 8 or 12 from a 120 roll, 24 or 27 from 35 mm, 8 from an instant pack. Frames you don't shoot aren't printed.
- Each roll comes with a card. Scanning it, or typing its code, opens the roll's digital copies in the app. If the card doesn't arrive, the roll opens in the app by itself some days after it was posted.
- The look of each print (light leaks, blur, colour casts, date stamps, mistakes in the darkroom) is part of the camera and the film. It's deliberate, it's different every time, and you can't see it until the prints arrive. A print that looks like that isn't faulty.
- The digital cameras don't use film and aren't printed.
2. Prices and paying
- The price is shown in the shop and on the Apple Pay sheet before you pay. In the UK, the EU and Australia it includes VAT or GST. In the US and Canada, any sales tax is added and shown on the Apple Pay sheet.
- You pay with Apple Pay. Payments are taken by our payment processor, Stripe.
- A next-roll coupon (from the card in your envelope) takes 10% off one roll of film, once, within 30 days. It can't be swapped for cash.
- If the price changes between opening the Apple Pay sheet and paying, the payment doesn't go through and nothing is charged.
3. Delivery
- We post to the UK, the US, the EU, Canada, Australia and New Zealand. The address must be in the country of the shop you buy from.
- Prints usually arrive one to two weeks after you hand the roll in. That's an estimate, not a promise: it depends on the lab and the post.
- Please check your delivery address in Apple Pay. We print and post to the address you gave and can't change it once the roll has gone to the lab.
- If your prints haven't arrived three weeks after the roll was handed in, write to us with the roll number and we'll look into it.
4. Your pictures
- Your pictures are yours. You let us, and our lab, use them only to print and post your order and to give you your digital copies.
- Please only shoot and hand in pictures you have the right to have printed. The lab may refuse to print pictures that are illegal, and we may cancel and refund such an order.
5. Refunds and cancelling
- Unused rolls: you can cancel and get your money back within 14 days of buying, as long as the roll hasn't been loaded into a camera. Write to us and we'll refund it to the card you paid with.
- Printed rolls: once you've handed a roll in, its prints are made to order from your own pictures, so they're personalised and can't be returned or refunded for a change of mind. (In the UK and EU the right to cancel doesn't cover goods made to your own specification.)
- Damaged, faulty or lost: if your prints arrive damaged, are misprinted by the lab, or never arrive, tell us within 30 days of when they should have arrived, with a photo if they're damaged. We'll have them printed again or refund you.
- Coupons and anything you were given free aren't refunded.
6. The beta
Phold is in a private beta before it comes to the App Store. During the beta things will change, and some may not work. Rolls bought with test payments during the beta are never charged, and may or may not be printed. If you pay real money during the beta, these terms apply to that purchase in full.
7. Our responsibility
We're responsible for getting you the prints you paid for, as described here. We're not responsible for delays or losses we couldn't reasonably have prevented, such as a postal strike. Nothing in these terms limits our responsibility where the law doesn't allow it to be limited, or takes away your rights as a consumer.
8. Changes and the law
We may update these terms. The terms on the day you bought a roll are the ones that apply to it. If you're a consumer in the UK, the EU or elsewhere, you keep the protection of the consumer law where you live.
